Yahoo, AOL in due diligence on combination: source

Yahoo Inc and Time Warner Inc’s AOL unit are looking at each other’s books to figure out how much money they could make together and where costs can be saved, a person familiar with the talks said on Wednesday, indicating a merger may finally be on the way.

While noting a deal was not imminent, the source said the two companies have engaged in “meaningful” due diligence about a possible combination for the past couple of weeks.

Talks are focused on how to integrate AOL’s content and advertising business into Yahoo, said the source, who was not authorized to speak publicly because the discussions are confidential.

Yahoo and Time Warner began talks several months ago, when the Internet company was looking for an alternative growth strategy to fend off a $47.5 billion takeover bid from Microsoft Corp.

Yahoo had repeatedly rejected Microsoft, which finally withdrew its $33-per-share proposal in June after Yahoo cut a search advertising partnership with Google Inc.

But the Google deal, also part of Yahoo’s alternative strategy, is mired in the regulatory process because critics have said it is anti-competitive. Meanwhile, Yahoo shares have plunged to around $12.

Time Warner shares are down about 45 percent from year-earlier levels, while Yahoo shares have fallen about 63 percent, as fears of an economic recession curbed corporate spending on advertising while Google continued to dominate in the Web search market.

Under the deal Yahoo and Time Warner have discussed, Yahoo would fold AOL’s content and advertising business into its own operations, and Time Warner would get a stake in the combined company.

Executives and advisers from both sides met last week as part of the due diligence process, the source said. Both sides are being cautious because any potential deal carries “a lot of risk,” the source said, without providing further details.

Integration concerns would likely revolve around how to fold AOL’s advertising network into Yahoo’s operations, choosing whether to keep separate portals and email services, and squeezing out cost savings by reducing duplication, one former AOL executive said on condition of anonymity.

Yahoo and Time Warner declined comment. News of the due diligence was first reported by the AllThingsDigital blog.

Shares of Yahoo were up 4 cents at $12.40 in late trading, while Time Warner shares were down 15 cents or 1.5 percent at

$9.95.

‘Chandrayaan orbit to be raised to 267,000 km Wednesday’

The earth orbit of India’s first lunar spacecraft will be raised to 267,000 km Wednesday, an official here said.

‘The Chandrayaan spacecraft, orbiting at a distance of around 165,000 km apogee (farthest point from earth) will be raised Wednesday to around 267,000 km. As of now, everything is normal and as per our expectations,’ Chandrayaan-1 project director M. Annadurai told IANS.

The third orbit-raising was done Oct 26 and the spacecraft was raised up to 164,600 km, instead of 199,277 km apogee as originally announced by the Indian Space Research Organisation (ISRO).

‘The important date for us is Nov 3 when the final orbit manoeuvre will happen. Between Oct 22 and Nov 3 we have the leeway to carry out the orbit raising activity,’ he said.

On Nov 3, the ISRO will take the spacecraft to 384,000 km apogee.

The subsequent firing of spacecraft motors will take it near the lunar orbit and it is expected to get into lunar orbit Nov 8.

During the lunar orbit, the spacecraft’s motors will be fired five times - called lunar burn - to take it to 100 km of the moon’s radius.

‘We expect that to happen November 14 or November 15,’ Annadurai said.

According to him the spacecraft has sufficient fuel on board.

‘Going up, the spacecraft spends less fuel to travel the same distance,’ he added.

On Oct 23, the spacecraft’s motors were fired for 18 minutes to take it to 37,900 km apogee.

Subsequently, the spacecraft motors were fired for 16 minutes and 9.5 minutes Oct 25 and Oct 26 respectively to take it to 74,715 km and 164,600 km respectively.

‘On Wednesday we will fire the spacecraft motors for 190 seconds (3.17 minutes) to take it to 267,000 km. On Nov 3, the motor firing will be for around 150 seconds (2.5 minutes) to take the spacecraft to 384,000 km,’ Annadurai said.

Till date, the spacecraft has expended around 340 kg of fuel of the lift off capacity of 819 kg.

The spacecraft’s motor firing Wednesday and Nov 3 would consume around 40-50 kg of fuel.

‘Another 100 kg fuel might be expended to put Chandrayaan into its intended orbit near the moon, leaving sufficient quantities of fuel for the spacecraft to orbit for two years,’ he added.

Mich. ad likens stem-cell work to Tuskegee study

A television ad created by opponents of a ballot measure that would allow embryonic stem-cell research in Michigan likens such work to the infamous Tuskegee syphilis study.

The ad, which began running Tuesday in the Detroit, Flint, and Saginaw areas, shows newspaper headlines and other references to the Tuskegee study.

In the study by the U.S. Public Health Service in Tuskegee, Ala., poor, black men with syphilis weren’t told they had the disease and were denied treatment when penicillin became available in the 1940s. The widely criticized study ended in 1972.

Proposal 2 on the November ballot would change the state constitution to allow people to donate embryos left over from fertility treatments for scientific research.

“Unfortunately, unrestricted science has had an ugly past,” the announcer warns, “and it’s been unfairly applied to the vulnerable and minorities. Proponents of Proposal 2 are now seeking the right to conduct unregulated scientific experimentation on live human embryos. They say they’ll have oversight and follow federal restrictions. But the problem is, there are none. Research without restrictions? Too much room for too much abuse.”

Dr. Lisa Newman, a University of Michigan professor of surgery, said in a statement released by backers of Proposal 2 that the ad “features distortions, fear-mongering and dangerous misrepresentations.”

“As a doctor and an African-American, I am outraged that this ad would use a tragedy in medical history to misinform the public about health care research,” Newman said.

A spokesman for the group responsible for the ad said it merely shows an example of the horrors of past unregulated scientific experimentation.

“We use an example of something that people recognize is a failure of federal oversight, of state oversight,” said Dave Doyle of Michigan Citizens Against Unrestricted Science and Experimentation.

An analysis by the nonpartisan Citizens Research Council of Michigan has said research on human embryos mainly would be regulated by the federal government if Proposal 2 passes. Embryonic stem-cell research conducted with federal funding is regulated by the National Institutes of Health, according the research council’s review.

Doyle contends that the proposal would keep Michigan lawmakers from regulating stem cell research, therapies or cures. He noted that not all research is funded federally.

The proposal is being fought most fiercely by Right to Life of Michigan and the Michigan Catholic Conference, which is the largest financial backer of the opposition group.

Google this: Why CEOs won’t speak their minds

Earlier Thursday, Richard Whitt, Google’s telecom and media counsel in Washington, posted a note on the company’s official blog urging people to put pressure on the FCC to open up the unused “white spaces” radio spectrum.

The Federal Communications Commission is going to vote on rules governing these airwaves at its November 4 meeting. This is going to be quite a big deal. Commission Chairman Kevin Martin supports the idea, but it faces opposition from broadcasters, who are pushing for a delay. Mike Masnick of TechDiret summarizes the history here.

“Basically, the FCC handed out a ton of spectrum (for free, mind you) to TV broadcasters years ago. In order to prevent against interference, there’s always been a requirement for some “buffer” space. However, as technology has improved, the need for this buffer space has decreased, and plenty of tech companies would be interested in making use of some of that basically unused spectrum by having it set aside as open spectrum. Earlier this year, some of those companies, led by Microsoft and Google, delivered a device to the FCC to test. Unfortunately, the device had some problems. However, the concept is sound — and with some tweaking, it’s quite reasonable that such a device could work without interfering with TV signals. But you wouldn’t know that from broadcasters, who love to hoard their spectrum.”

The fact that Whitt lobbied on behalf of his company’s cause is hardly surprising. What’s more interesting is that Google’s executives are as comfortable as they are when it comes to drawing lines in the political sand.

High-profile companies try to avoid controversy. Wading into public policy, there’s always the risk of alienating customers or partners. That’s why PR handlers at Google-scale organizations council their executives be be boring to the point of soporific when it comes to any subject remotely bordering on the political.

But that did not stop CEO Eric Schmidt from endorsing Barack Obama. Ditto for Vint Cerf the company’s vice president and “Chief Internet Evangelist,” who put a video on YouTube where he explained his decision to vote for Obama.

(Officially, Google doesn’t have a horse in this race and companies are prohibited from making campaign contributions. You can find Obama contributors who listed their employer as Google on a list compiled by Opensecrets.org. But that doesn’t reveal much other than that people have opinions. What a shocker. You can find much the same thing about Microsoft, Yahoo, or any other high-profile technology company, for that matter.)

The anti-Schmidt blowback in the online talkback forums was predictable. One reader with the handle “Gerry S” left this message:

“What kind of an idiot would support the likes of these people in any way? Attention stockholders, if this is the business mentality of certain business leaders, then you might want use their judgment to assess their leadership skills.”

That’s to be expected, but I found the decision by Schmidt and Cerf to go public quite refreshing. Last month, company co-founder Sergey Brin announced Google’s opposition to Proposition 8, a California ballot measure that would prevent same-sex couples from marrying.

Even though the tech firmament is comprised of a lot of very smart people, they don’t like to stick out their necks. With rare exception–aside from Steve Ballmer’s “heck with Janet Renoquip–the only technology leader who has consistently been willing to stake out public positions on policy questions is T.J. Rodgers of Cypress Semiconductor.

Or they discover their lungs after retiring.

Judy Estrin, one of tech’s most successful entrepreneurs, recently authored a book, Closing the Innovation Gap: Reigniting the Spark of Creativity in a Global Economy. The book is a marvelous, albeit depressing read. Nothing was out of bounds–from the politicization of science and the neglect of the nation’s research community to the need for new political leadership. But might Estrin just as easily have offered the same critique when she was still a working stiff? I’m not so sure. We’re all so careful these days to tiptoe around the obvious that the frank talk most often takes place behind closed doors.

Too bad. With the nation facing both an economic recession as well as a vexing energy challenge, is now really the best time to be talking in hushed tones?

Indian equities markets continue to shed value

With Argentina joining the growing list of countries hit by the global financial tsunami and weak global cues, Indian equities markets continued to shed value Thursday and a key equities index dipped below the psychologically important 10,000 mark mid-afternoon.

Despite lower Indian inflation figures and several positive measures announced by the Indian government, central bank and the market regulator over the past few days, continued uncertainty across the globe was affecting sentiment, analysts said.

Mid-afternoon at 1.30 p.m., the benchmark 30-share sensitive index (Sensex) of the Bombay Stock Exchange was at 9,914.31, down 255.59 points or 2.51 percent from its previous close Wednesday at 10,169.90 points.

The Sensex opened very weak at 9,683.41, down 486.49 points or 4.8 percent from its previous close Wednesday, hit a low of 9,681.28 and then recovered somewhat on lower inflation rate figures.

The broader 50-share S&P CNX Nifty index of the National Stock Exchange (NSE) also opened weak and went below the psychologically important 3,000 mark before recovering somewhat to rule at 3015.65, 49.5 points or 1.61 percent from its previous close Wednesday at 3065.15 points.

The BSE midcap index was at 3,391.69, down 98.70 points or 2.83 percent from its previous close Wednesday at 3,490.39 points.

The BSE smallcap index was at 3,988.97, down 122.72 points or 2.98 percent from its previous close Wednesday at 4,111.69 points.

Metal and automobile stocks were leading the downward rally and information technology and consumer durables were the top gainers.

Overnight the New York Stock Exchange’s key industrial index closed 6.95 percent down while the key index of the Nasdaq - the stock exchange for technology stocks - finished with a 4.77 percent loss.

Asian markets also provided negative cues with the Nikkei index of the Tokyo Stock Exchange down 2.46 percent and the Hong Kong market’s Hang Seng down 4.65 percent.

Ivanovic and Zvonareva reach Linz quarter-finals

Top seeds Ana Ivanovic and Vera Zvonareva claimed straight-set victories on Thursday to reach the quarter-finals of the Linz Open.

Number one seed Ivanovic of Serbia overcame a strong but inconsistent challenge from Austrian left-hander Sybille Bammer to win 6-4 6-2, while Russia’s Zvonareva took just 53 minutes to defeat Nuria Llagostera Vives of Spain 6-2 6-0.

Ivanovic had struggled since winning the French Open but she returned to form last week in Zurich, reaching the semi-finals.

She maintained that form against Bammer, playing aggressively and looking for opportunities to come to the net, although it took her time to get into her stride.

Ivanovic broke to lead 1-0 but then allowed Bammer to level at 2-2. The next two games also went against serve, before Ivanovic faced another break point that would have left Bammer serving for the set at 5-3.

The Serb held off the threat with a high backhand volley, and went on to break Bammer to lead 5-4 before closing out the set with an ace.

Ivanovic looked more comfortable in the second set, moving better and showing more consistency. Although Bammer engaged her in several competitive rallies, it was usually the Austrian who made the error.

A double-fault gave Ivanovic a break for 2-1 and a further break for 5-2 left her serving for victory, and she once again claimed the set with an ace.

“I’m very happy with the way I played today,” Ivanovic told reporters. “She’s a tough opponent. She brings a lot of balls back and makes you work hard for your points, so to have a victory like this in two sets is definitely good.”

Zvonareva experienced little resistance from Llagostera Vives, with her aggressive baseline game often forcing errors.

The Russian broke twice to lead 5-1, and although she netted a backhand to lose the next game she broke once more for the set. The second set was entirely one-sided, and ended when the Spaniard hit her fifth double-fault.

Sixth seed Marion Bartoli also progressed after struggling to overcome Czech qualifier Petra Kvitova 7-6 1-6 6-3 and fifth seed Nadia Petrova beat Katarina Srebotnik 6-4 7-6.

The seventh annual secret vote ahead of Tuesday start of the 2008-2009 season showed general managers expect the Lakers to avenge their loss to the Boston Celtics in last June’s NBA Finals by beating them in next year’s final.

A total of 46 percent of the league’s 30 team decision makers liked the Lakers to take the crown with defending champion Boston next at 19 percent followed by New Orleans at 12 percent.

The San Antonio Spurs were not the top pick for the first time in five years in the poll, garnering only eight percent.

Cleveland playmaker LeBron James was predicted to become NBA Most Valuable Player by 56 percent of general managers and 2008 MVP Kobe Bryant of the Lakers was next at 37 percent. New Orleans’ Chris Paul was third with seven percent.

Miami’s Michael Beasley, the second selection in June’s NBA Draft, was predicted to take NBA Rookie of the Year honors at 48 percent.

Last year’s top overall pick, Portland center Greg Oden, was second on 30 percent. He missed last season with an injury.

Dallas forward Dirk Nowitzki was named the top non-US player, the German taking 67 percent of votes among international talent.

Chinese star Yao Ming, who had been rated the NBA’s best center in the poll last year, was overtaken by Orlando star Dwight Howard, who took 56 percent of votes. Paul topped Canadian Steve Nash of Phoenix for top point guard as well.

Forward James and shooting guard Bryant were named the best at their positions along with power forward Tim Duncan of San Antonio. Bryant and Duncan have topped the vote at their positions in every year of the poll.

James was named top player execs would sign to build a team around while Bryant was named the one they most wanted to take a last-second shot with the outcome at stake.

Greg Popovich was named best coach in the NBA with 54 percent of votes while Boston’s Kevin Garnett was picked as top defensive player and Lakers’ big man Andrew Bynum tabbed as top pick to have a breakout season after being injured most of last season.
